A 2020 federal mandate is trying to force New Jersey herring fishermen to pay for monitors, who ride their boats and report back to the government. The D.C. Circuit upheld this action by relying on the Chevron doctrine, which defers to agency interpretations of so-called ambiguous statutes. But the statute here is clear and it gives no authority to the government to force these fishermen to pay for the monitors. Cause of Action Institute is asking the Supreme Court to review this case.
